Again, the Apple is considering taking legal action against a rival, this time to protect the name of your app store, the pioneer App Store.
The initiative is mainly because of growth of the Amazon in the mobile area. Encouraged by the success of the Kindle Fire, the megastore is expected to release new versions of the tablet and possibly even a smartphone, and bolster the image of your 'Amazon App Store'.
Since Apple just released the economy of the applications with the iPhone and the very concept of a smartphone, the name App Store has been considered by generic companies that decided to invest in niche and was embraced by several brands in their own systems for the provision of software .
The U.S. brand claims, however, that this can lead to confusion among consumers, so it is likely to act legally against the companies that adopt the term.
The first lawsuit to ban the use of the mark was made in March 2011, when the name was still Amazon Appstore for Android. But now the Silicon Valley company claims that the Amazon App Store omitted the supplement 'for Android' to knowingly induce consumers to confusion with the Apple store.
Meanwhile, Apple tries to get the copyright registration of the mark in the U.S. App Store - a process that has been challenged by Microsoft and is still being decided - and also in Europe.
The company has gained notoriety for framing their competitors on the court and try to use legal action to prevent that they can make inroads in areas that Apple is strong, especially in the production of tablets and smartphones. The favorite target is Samsung, which had already banned the sale of tablets in the United States and Europe.
